1. Introduction
This Privacy Policy explains how Lamkone Restaurants, Inc., doing business as Wahoo’s Fish Taco (“Wahoo’s,” “we,” “us,” or “our”) collects, uses, and shares personal information when you visit www.wahoos.com (the “Site”), use the Wahoo’s mobile app (the “App”), join our loyalty program, sign up for text messages, buy merchandise or gift cards, or contact us. It also explains your privacy rights and how to use them.
Your privacy is very important to us. We collect only what we need for the purposes described here, we keep it only as long as needed, we protect it with reasonable safeguards, and we tell you plainly what we do with it. This Policy covers the Site, the App, and our loyalty and messaging programs, including loyalty activity recorded when you scan or provide your account in our restaurants. It does not cover third-party online ordering platforms, which have their own privacy policies.
2. Information We Collect
- Information you give us: name, email address, and phone number when you use our contact form, join the loyalty program, or sign up for texts; billing and shipping details when you buy merchandise or gift cards (payment card numbers go directly to our payment processor and are not stored by us); account details if you create an App or loyalty account; and anything you include in messages to us.
- Information collected automatically: device and usage information such as IP address, browser type, pages viewed, and links clicked, gathered through the technologies in Section 4.
- App location: if you turn on location services, the App uses your device’s location to show nearby restaurants and relevant offers. Depending on your device settings this may be precise location, which California treats as sensitive personal information; we use it only to provide the location features you request and not for any other purpose. Location access is optional and can be turned off any time in your device settings; some location features will not work without it.
3. How We Use Information
We use personal information to run the Site, App, and our programs; process and ship orders; operate the loyalty and text programs; respond to you; measure Site traffic and advertising results; prevent fraud and secure our systems; and meet legal obligations.
4. Cookies and Tracking Technologies
The Site shows a consent banner, and non-essential tracking runs only according to your choices. You can change your choices any time through the Cookie Preferences link in the Site footer, and a full list of technologies with on/off toggles is on our Opt-out Preferences page. In summary, the Site uses Google Analytics for usage statistics, Cloudflare Web Analytics for performance measurement, the Spotify Pixel, the Meta Pixel, GroundTruth advertising pixels, and a Google Ads tag for advertising measurement, and WooCommerce and Stripe cookies for the shopping cart and secure checkout. We honor the Global Privacy Control browser signal as an opt-out of advertising-related sharing.
5. How We Share Information
- Service providers: companies that process payments, administer gift cards, host and secure the Site, deliver email and text messages, and provide analytics. They may use personal information only to provide services to us.
- Advertising measurement: through the Spotify Pixel, the Meta Pixel, GroundTruth pixels, and a Google Ads tag, information about your activity on the Site, such as pages viewed and links clicked, is made available to Spotify, Meta Platforms, GroundTruth, and Google for advertising measurement, campaign attribution, and related advertising purposes. Under California law this may count as “sharing” for cross-context behavioral advertising. You can opt out as described in Section 11.
- Legal: we may disclose information to comply with law, respond to lawful requests, protect rights and safety, or as part of a merger or sale of the business.
We do not sell personal information for money.
6. Loyalty Program Financial Incentive Notice
Our loyalty program offers rewards, points, and member offers in exchange for joining and letting us use the information described above (contact details and purchase history) to run the program. California law treats programs like this as a “financial incentive.” We estimate in good faith that the value of the personal information members provide is reasonably related to the value of the rewards they receive, based on the retail value of discounts and offers redeemed by members. Joining is your opt-in to the program. You can withdraw at any time by deleting your account in the App’s settings or emailing [email protected]; after withdrawal we stop using your information for the program, though we may retain records needed for tax, accounting, fraud prevention, honoring your opt-outs, and legal compliance. We will never deny you goods or services, charge different prices, or provide a different level of service because you exercise your privacy rights.
7. Account Deletion
You may request deletion of your account and associated personal information through the App’s account settings or by contacting us at [email protected]. We will process valid requests in line with applicable law and our retention requirements.
8. Third-Party Sites
Online food ordering runs on third-party platforms you reach through links on the Site, gift card services are hosted by our gift card provider, and social media links lead to platforms we do not control. Each has its own privacy policy worth reviewing.
9. How Long We Keep Information
We keep loyalty and App account information while your account is active and delete or de-identify it after deletion requests are processed. Purchase records are kept as required by tax and accounting rules, generally up to seven years. Marketing contact information is kept until you unsubscribe or opt out. Analytics data is kept for the retention period configured in each tool, currently up to two years. We delete or de-identify information when it is no longer needed.
10. Your California Privacy Rights (CCPA/CPRA)
This section is for California residents. In the last 12 months we collected these categories of personal information: identifiers (name, email, phone, IP address); commercial information (purchases); internet activity (pages viewed and actions on the Site); geolocation (App, if enabled); and inferences drawn from the above. We collect them for the purposes in Section 3 and keep them as described in Section 9.
You have the right to know and access the personal information we have about you, delete it, correct it, opt out of sale or sharing (Section 11), and be free from discrimination for exercising these rights. To make a request, use our online Privacy Request form, email [email protected], or call 949 223 6127. We verify requests using information like your email address and past interactions, and you may use an authorized agent with proof of authorization. Opt-out requests under Section 11 do not require identity verification.
We provide notice at collection where information is gathered, such as at contact forms, loyalty and text signup, checkout, and App permission prompts, with links to this Policy and to the opt-out mechanism. We do not use or disclose sensitive personal information for purposes that require a right to limit, and we do not knowingly sell or share the personal information of anyone under 16. Under California Civil Code Section 1798.83, we also note that we do not disclose personal information to third parties for their own direct marketing purposes.
11. Do Not Sell or Share My Personal Information
We do not sell personal information for money, but our use of the Spotify Pixel, the Meta Pixel, GroundTruth pixels, and the Google Ads tag may count as “sharing” under California law. To opt out: visit the Opt-out Preferences page or the Cookie Preferences link in the footer and turn off Marketing; or turn on the Global Privacy Control signal in your browser, which we honor automatically; or email [email protected] with the subject “Opt-Out Request.” Your opt-out applies to the browser and device where you make it, so you may need to repeat it if you clear cookies or switch devices.
You can also submit an opt-out request, or any other privacy request, through our Privacy Request form.
12. Other U.S. State Privacy Rights
Residents of Colorado, Texas, New Jersey, and other states with comprehensive privacy laws have rights to access, correct, delete, and obtain a copy of personal information, and to opt out of (1) targeted advertising, (2) the sale of personal data, and (3) profiling in furtherance of decisions that produce legal or similarly significant effects. We do not sell personal data or engage in such profiling. You can exercise these rights using the methods above, and we treat the Global Privacy Control and other recognized universal opt-out signals as an opt-out of all activities they legally cover. If we decline a request, you may appeal by emailing [email protected] with the subject “Privacy Appeal,” and if the appeal is denied you may contact your state Attorney General. Nevada residents may direct us not to sell certain covered information by emailing us; we do not sell covered information as Nevada defines it.
13. Children
The Site, App, and our programs are not directed to children under 13 and we do not knowingly collect their information. If you believe a child has provided us personal information, contact us and we will delete it.
14. App Permissions and Push Notifications
The App may request device permissions such as location and push notifications. Both are optional and controlled in your device settings, and you can turn push notifications off at any time without affecting the rest of the App.
15. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure.
16. Changes to This Policy
When we update this Policy we will change the effective date above, and for material changes we will post a notice on the Site. Continued use of the Site after changes take effect means the updated Policy applies.
